I still travel the same route and almost daily I see people in lane 1/2 wanting exit 3 and this includes professional drivers (i.e. HGV drivers).

HGV's are a little different, they may move left to turn right OR move right to turn left..... Unless they indicate, stay WELL BACK.

The reason it's so hard to prove liability on traffic islands is that unless there are witnesses, the insurance companies will want to go 50/50.... Only 50/50 guarantee's a profit for both insurers, when you consider extortionate repair costs, extortionate hire car costs and everything else they make a fair chunk of cash out of your claims.

If I ever got in this situation on a unfamilar roundabout I would take the exit I was positioned and indicated for and turn around and get back on the roundabout and try again! I see so many people do silly things on roundabouts and doing illegal U-Turns, when they could just drive on and turn around in a safe mannor. Everybody is in such a rush these days.

No help to your OP, but good luck getting things sorted! :)

This case seems quite similar to the OP, MissKool. The fact that MissKool signalled when she realised she was in the wrong lane might be enough to show that she was not negligent since by indicating, she did take into account the potential danger she presented to other road users.

What may be crucial is the point at which the OP made her right signal. If MissKool signalled early enough to give plenty of warning to other drivers, then that would imply that the other party was negligent for failing to heed that signalled warning from the OP.

    .

I am pretty certain (although without a witness one cannot be sure of anything), that I indicated as I was coming up to the second exit, I indicated right and he assumed I would be getting off at the third exit which is where he hit me. I have a photo but since I'm sending this to the insurers I don't want to put it on MSE :)

If you want to experience an 'interesting' roundabout try the Magic Roundabout in Hemel Hempsted. Its a set of 6 small roundabouts around one large roundabout which means you can go round the large roundabout in either direction (clockwise or anti-clockwise).
