Deposit not in a protection scheme

I haven't had anything to do with it but my housemate who deals with all the bills tried to sort it with them and the person at British Gas told her that as the name is 'The Occupier' and not any of our names then it is the LLs responsibility.   • Thanks for all the replies people. We have no reason not to get our deposits back but the LL can just be a bit dodgy with all the lying and stuff. I sent a long email to her last night stating that I knew where I stood legally and she admitted that she never did protect my deposit and the certificate was in the kitchen when I came downstairs this morning, so that little word 'court' kicked her into action, as I would imagine it would to most LLs like her! :)

    Update on this, it turned out that the deposit protection certificate was for D's deposit and LL had just returned my money to her, so my deposit still isn't protected.

    We moved out on 30th June when the tenancy ended and have heard nothing from our LL since. We had an inventory inspection and everything was as it should be and we were told we would get our deposits back by the maintenance man, but not sure he's qualified to say if we get it back or not!

    The 4 of us have tried to contact the LL but s/he (a couple) has not answered phones, emails or texts. One housemate sent a letter which was received (recorded delivery!) but no answer from that either.

    All the bills have been paid as requested and the house was cleaner when we left than it was when it was first let, we cleaned all the garden (despite LL saying they'd do it as it had nothing to do with us), scrubbed all the walls, floors, defrosted the fridge freezer, left the bathrooms sparkling clean and the whole house spotless (bar the carpets but we were told not to bother cleaning them as they were being replaced). Now we can't get hold of the LL we're not expecting to get our deposits back. My three housemates have protected deposits, but I don't, unless we can actually count D's deposit as mine, which I'm pretty sure we can't?

    Where do I start with reclaiming the costs through SCC? I am going to send a letter to her first to see what happens, but not expecting a reply so shall then proceed with court action.
  • Can anyone help? I have sent a letter yesterday to the LL about it but I'd be surprised if anything comes of it. How long do I have to wait before taking further action? It has been 14 days since I moved out.
