deposit not in scheme CAB not that helpful

Just phoned the CAB to find out if my landlords can keep any deposit even though they didn't secure it in a scheme, I said they want us to have all carpets professionally cleaned before we move out and he said well presumably that what your agreement says is it I said no it doesn't and all they could say was its something you need to work out with your landlord helpful!

    No they can't make you get your carpets professionally cleaned -especially if it doesn't even say so on the contract. I have a feeling you have been given advice on previous threads re sending the lanlord a letter reminding them that you want your deposit back in full or you will be taking them to court for 3 times that amount.

  • Most rental agreements stipulate that the carpets need to be cleaned to a professional standard. How that standard is achieved is up to you. I suggest that you consider hiring a Rug Doctor for about £20 a day and do it yourself.

    This is all assuming that there was a full inventory at the start of your tenancy. Your obligation is to return the property and all its contents in exactly the same state as at the start of your tenancy.

    Your landlord and their agent can try and make a deduction from your deposit but if it isn't lodged with one of the three approved schemes they are going to be on a very sticky wicket. In the first instance you MUST check with all three schemes yourself. Once you have done that and they've confirmed that your deposit hasn't been lodged you will need to consider either WRITING to them and pointing out the very weak position they are in or taking them to the Small Claims Court once your tenancy has ended.

    I have been given advice yes but someone said the other day that it MIGHT be the case that their not even aloud to withhold any deposit if it wasn't held in a scheme so I phoned up to ask about that, there was no inventory no mention of professional in any shape or form :) im happy to clean all carpets with my vax when we empty the house but Im doing no more, Ive re painted all problem walls but in all the time we have lived here they haven't sorted any of the problems that have been their doing until we handed in the notice and wow there is a builder to fix a hole that has been there for 2 years
