How do we deal with this?

We moved into our new home on the 14/02/2011

We previously received a letter from LCS on behalf of E.0n advising us that there is an outstanding balance of £85.57, in addition to this they have added an administration charge of £19.68 - these charges were for energy used between the 24/11/2010 - 04/02/2010.

As we didn't live here at that time, we filled out the form they sent and told them that we weren't the tenants during those dates.

We've now just received another (more strongly worded) letter which threatens us with legal action.

Needless to say, we wont be paying them a penny.

Could any of the lovely chaps or chapettes on here be of assistance... I'm lost as to what we do next.

So, Energy gurus... I await your help

Write to them, recorded delivery, enclosing a copy of your tenancy, strongly asking them to cease and desist chasing a debt that is not yours. I would also send a copy to your letting agents or LL if renting privately.

Post the problem on the DebtFreeWannabe section with a link back to this thread [and either edit you post here or add another to say that is what you have done]. There are OFT guidelines which I am sure are being breached here. The DebtFreeWannabes have the expertise.

The company left an e-mail address, so I'll likely send a reply to that.. don't see why I should spend my money on sending them a recorded letter... hmm would they reimburse me?

Hi daggy,

I just wanted to check a couple of things, if that's ok.

When you moved in to the property, did you advise E.ON that you had taken over responsibility of the house and give your first readings?

Is the account now set up correctly in your name and billed using your meter readings?

It may be that you will have to do as spinningsheep has suggested and send a copy of your tenancy agreement.

Sorry for all the questions, but it should point us the right direction of what to do next.

Thanks for your response.

I have a bill that shows that the first meter reading was taken on the 5th February (by the people we are renting off). Our Tenancy started on the 14th.

The account is with E.on and has been changed into our name.
