where do i stand on out of warranty repair of same issue?

i bought a white macbook in december 2009. in october 2010, i spotted 2 hairline cracks on the hinges of the upper case (seems to be a fairly common problem). apple repaired this and another fault gratis as it was under my warranty. no problem there.

6 months later and the cracks have re-appeared (well, one has, the other side is still ok for now).

now, i know and understand that my warranty is up, but seeing as this was an issue that was supposed to have been rectified within the warranty and 6 months later it's happened again, would i have a leg to stand on from a legal perspective, or will it depend on the policy and/or goodwill of apple?

    Have a read of MSE's Consumer Rights article.

    You will see that if you can establish the the fault is inherent (was there at the time of sale), you have a right to a repair, refund or replacement.
    After six months it is for you to prove the fault is inherent.

    Those rights are against the seller... not manufacturer.

    That's the legal postion.
    However, you may well get a good response from Apple, but there is nothing they legally have to do (unless you bought the thing direct from Apple of course).

    that's the old macbook, the squarer one. the one i have it the late 2009 unibody model, but thanks all the same
