Hi the fence between our property and the neighbours needs two panels replacing and it is his turn he has been told time and time again and we have put some chicken wire!
He keeps on refusing to replace them or makes up some excues and now our dogs are getting in his garden and messing and the Mal likes to dig.
Has anyone got any advice on what to do please.
Should we go and clean up after the dogs?

Replacing fence panels is down to the owner of the fence it is not usuallly a shared responsibilty. Your deeds should indicate who owns the fence & is therefore responsible for maintenance. In most areas you are responsible for the boundary on the left of your property as you stand with your back towards your house but this is not always the case so you need to check your deeds to be sure.
You should not be allowing your dogs to foul on your neighbours property in the first place as the owner it is your responsibility to keep the dogs under control. If you have put up chicken wire across the gap then how are they getting in there?
As they have already fouled there then yes you should clean up after them but should seek your neigbours permission to enter their garden to do so first.0 -
The mal is an alaskern Malamute which is a big dog and very strong.
No way are we going to keep him penned up in a little area when he has a 100 x 50 foot garden to play in and a pond to to play in (he loves water)!!!!!!
Thinking about it the fence is the neighbours and not ours.

This is a total, but very persistant, myth! Some house owners are responsible for all the fences around their property, some just the back one, some on one side, some on the other. Some aren't responsible for any fences.
Your deeds should have T marks showing which fences you are responsible for. Even if there are T marks, no-one has to put up a fence unless there is a clause in the deeds stipulating that they do.

No, it isn't. He doesn't have to replace the fence at all if he doesn't want to. He could take it all down and leave the boundary marked by some posts and a wire if he wanted to.
You need the fence so you have to replace the panels.0 -
But your neighbour has no incentive to put up a fence or maintain it. There is no legal obligation on him to do so. Its up to you to do whatever is necessary to control your animals and livestock. It looks like you are expecting your neighbour, by maintaining his fence, to do that for you.Eat vegetables and fear no creditors, rather than eat duck and hide.0

We had a panel fence that we went halves on cost with the neighbour as we didn't know who officially owned it. There was nothing in the deeds to say who owned it.
Several years later the panel fence was damaged by high winds and we have two dogs that were escaping next door.
My neighbour was terminally ill with cancer, so obviously replacing a fence was the last thing on his mind! I just popped round and said we were going to get the fence sorted out and asked if it was ok for the workman to be in his garden and use his side gate if necessary. He said that was fine, so I just went ahead and organised it to be done.
I thought that was the best way of doing it as it gave him the chance to offer to contribute if he wanted to, but I didn't put him in an awkward position or fall out with him.Here I go again on my own....0 -
Our neighbour has is a complete pri88 since his wife and two dogs left him.

Irritating as the situation might be and, as unfair as it might feel, it's still down to you to replace the panels and control where your dogs go. At least now the wife has taken their dogs, they won't damage your new panels.0 -
You have a responsibility to ensure your dogs do not go next door and are secured if left to roam in your garden. If your dog goes next door and bites that person then you're have all that to deal with.
Get the fence sorted for your own peace of mind0
