Just wear the shoes, and if they break again, then send them back, and THIS time, point out that it's the second pair that have broken, and therefore you do NOT want a replacement this time, as you no longer have any confidence in their product.

If you don't wear them, how do you know they're not fit for purpose again? The first pair could have had a genuine fault.

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Christ, how many people are on here to bring you down!?
For the people who are interested, they have finally responded to me saying "we can not accept the exchange. Unfortunately you can not return for a refund as you are over the 7 day cooling period for your shoes"
So I'm not allowed an exchange, or a refund for some brand new unworn shoes that I've only had since Tuesday...what the hell?! What can I do? :(

Unfortunately because they are your replacement pair the 7 day period for the DSR do not reset ( because that could lead to unlimited returns / exchanges )

People here may be a little rough some times, but slot of the time they are giving good advice just not how you may like it put across.

Wear this pear and if they break again then surely they are unfit for purpose and seek the exchange you wanted or a refund under the sales of goods act :)

You never know this pair might be fine :)

The company has done nothing wrong by sending you a replacement pair, and you are not entitled to return these unless they too have a manufacturing fault.

I would recommend wearing them and seeing what happens. Personally I've never had a problem with elastic on any shoes, so it might have just been that the first pair you received had some dodgy stitching. If they do break, this time include a letter which states that you would prefer a refund (or an alternative) rather than another pair of the same.

I don't really think that there is anything else that you can do.

Christ, how many new posters are RUDE to people who have spent time trying to help by pointing out their rights and what is deemed reasonable, just because it's perhaps not what they want to hear?!

As per my post 13, why not just wear the shoes? If they break again (I recommend perhaps going jogging in them), then reject them and insist on a refund this time.

As the first pair were faulty, then the shop had to either repair, replace or refund. They chose to replace.

You had 7 working days from the day of purchase to cancel under the cooling off period.

Lol why should it have anything to do with them being a new poster? Being new to a forum doesn't automatically make them lacking in humour or the ability to take advice. I'd say it's more the way people are coming across in their posts than what they are actually saying. Some people are pretty rude on this forum and they've got hundreds of posts. Funny how it's ok when it's the other way round.

It's not OK for anyone to be rude on a forum.

The majority of regular posters know that when asking for advice on a public forum, you will get a variety of opinions, and although you might not agree with them, they often have a very good point!

There are a LOT of new posters who seem to just ignore what they don't want to hear, and just thank posters that tell them what they want to hear, which somewhat defeats the point of getting impartial advice to a situation.

The above situation is quite clear. The shoes are blatantly cr*p, so all the OP has to do is wear them again, and when they break (which is clearly likely), they send them back again, and insist on a refund this time.
