thanks all for the brilliant advice and scenario's in which a solicitor could put forward.
the first solicitor was a free half hour and the second solicitor is the current solicitor who said he can go for 50%.
Its really helped and now have a few ideas to put to my dad, which can be brought up with the solicitor. I appreciate we shouldnt have to do this because they should act always in our best interests and have considered all aspects - but it doesnt hurt to check and question his suggestions afterall nobody is correct 100% of the time!
hopefully he can put forward a compelling argument as to why he isnt actually entitled to anything and offer a settlement as a gesture of intent to end this drama of somewhere in the region of 7-12k.

I think the key may be proving that in the time they spent there together she paid her way just as much as him, coupled with the fact the the massively reduced rate was down to her rental payments over many years.
