Hi, could anybody help me with my situation.
I took out a car insurance policy with Hastings in Sept 09, in Sept 10 when it was due to be renewed I just left the policy to run even though the monthly premiums went up by £20 per month, then in Nov 10 our car was on its last legs so we part-exed it for a new car and took out a new ins policy with a different company. Due to the stress of christmas I totally forgot to cancel our Hastings policy on our old car so in Jan 11 we finally phoned them and explained that we part-exed the car in Nov but continued to pay to which they said we should send them proof of part-ex so the payments made after that can be refunded which we did and got a cheque for overpayments. Then we received a letter from a credit company saying we owed Hastings money which we ignored. Then today we got another letter saying that they are now advising Hastings to take legal action, so we phoned this company who said we owed £192.16 but as a good will gesture they will knock 30% off as long as it is paid off in April, I was quite irate on the phone so not sure what exactly this amount is for, something to do with cancellation charge and outstanding payments. I told this person that I had not agreed to this new policy I just let it run to which he said once I had made that 1st payment then that was my "agreement" to anither 12 month contract. Is this correct, any advice welcome, thanks, Louise. :mad:
Also, I cannot find my original policy from 2009 so dont know what was in the tc's.

That is different to what you say at the start of the post where you say it renewed in Sept and you bought a new policy without cancelling the old one in November.
You need to get your story right as giving misinformation and incorrect details will not help your case.
Contact Hastings and get them to confirm in writing the policy was cancelled and a refund cheque was issued and that you have no liability with them. Just to add to what Dunstonh said, also write a letter to the agency who wants the money informing them that you are trying to settle this and waiting for documents from the Insurance comapny.
What you can also try to do is cantact customer services and ask the person on the phone about the status and info on file. they can then inform you if a cheque was sent out and request a copy of that letter and also a letter to confirm when the policy ran out.
What happened with me some time ago was that I had a policy and it was running out, I then looked online and got a better quote which I then moved to, a few weeks later my old insurance said they couldn't get the money from my card and that I should pay them this stupid renewal price or the dept agency would come round.
I called up and advised the lady that I had insurance and therefore I should not have to pay the full amount, and at most only for the days up until payment was not received. She was being stupid and saying that I was billed and that was it, I had to pay up.
I called a lot and got the same reply. In the end I said take me to court and Ill let the judge decide, been over 2 years so they cant have it now anyway if they do try and want it.
What Im trying to say is that if you owe Hastings anything it should be until you didn't pay and cancelled automatically, unless you crashed and made a claim in the short time.0
