halifax mortgage charges

Hi dont know whether this is the right thread.Basically my new partner her ex huspand is supposed to pay the mortgage on her house because he left and his kids are still in the house.The court order says if he does he will get 1/3 of the price of the house when the youngest is 17.He hasnt paid the mortgage and the halifax is charging £35 for each letter they send out to say this.Basically threat of repossesion but can we claim back these charges from the halifax?.Anybody have any experience of this thanks for any replys.
