Warranty on Mobile not Valid!

Hi,

I purchased a mobile phone online from Prepaymania about 16 months ago. Unfortunatley the phone has a fault but Samsung offer a 2 year warranty so they arranged for it to go to a repair centre.
The phone has been returned un-repaired stating that it is has an invalid European warranty.
When I enquired further I discover it was made in India and not to EU specification so no repairs can be done in the Uk.
The suggestion was to complain to Prepaymania and request a replacement that is European Spec.
Obviously, so far, I have not got anywhere with my complaint to Prepaymania, they state it is out of their 1 year warranty.

Any suggestions how I can progress this?

    Seller warranty = 12 months .
    Samsung Warranty = No extra warranty on a grey import that does not meet the specifications for that extra warranty .

    No claim against Samsung only claim can be against seller but on what grounds .
    Did they tell you or show you it came with extra warranty from Samsung .
    Or did you just buy the phone and presume then or at a later date that it was covered by Samsungs extra warranty without reading the requirements of that warranty .Who would most of us would presume we had been sold a phone that was covered .

    Trading Standards is your next step .

    I spoke to Trading Standards, who said that the SOGA applied as the goods were not as described (by ommision, one presumes) and that the expectation was that in a UK shop, it is reasonable to expect a UK camera unless otherwise stated. I spoke to Which? legal services, who agreed, adding that I had been induced into the transaction in the expectation of obtaining UK goods.

  • Hi, Just thought I'd up date you all.
    After letters to Prepaymania and Samsung I have had no luck. I have spoken to trading standards and they say I have a case against Prepaymania. Their suggestion is to write again and then small claims court.

    Keep us up to date.
    If it wasn't for the mistakes I made in the past (and learned from), I wouldn't be who and where I am today. It doesn't matter if you've cocked up, what matters is that you put it right and apologise. x
