ESA help please about second medical

    i was under the impression that CB ESA doesnt run out like JSA
    It will do soon for those in the Work Related Activity Group.

    They will get a year.

    as far as I am aware that year starts from your claim and not from the WCA

  • wel i have already been on CB ESA for over a year now so when will it go over and im in a work related group not that its much help when you can hardly walk and awaiting 2 major back operations

    I dare say it will come into effect in your case straight away if you fail the wca, but can't be sure as that rule only applies to new ESA claims.

    If you do fail, then appeal, nobody in your situation should be found fit for work
    Just sold a lawnmower on Ebay.. That's the last time my neighbour will wake me up on a Saturday morning!

    i will appeal and go to tribunal if i have to, i am a very heavy qualified person in my field of work and have worked for 20 years solid and to be honest why would i want to stay on ESA getting £91 per week if i really didnt have to when i could be earning £45k + and cant wait for the days when i can get back to that but its not all about the money im hoping after i have had my operations and fully recovered to the best i can get to i will be able to spend time with my daughter that lives with me and my 2 other children and be the dad i use to be

    It hits many of us at some time in life :(

    We never expect it to happen to us, but sadly it does. If it dosn't then those people are very, very lucky

    I have Breast Cancer which wasn't detected till it hit my lungs, so my lungs are badly damaged.

    I didn't have to attend a medical, I had a "telephone medical" - the less said about that the better.

    I to was told I had to wait 13wks to be assessed; i explained that I'd been off work for over 6mths and didn't need assessed!

    After a few weeks of arguing, I GOT MY FULL RATE BACKDATED TO THE 1ST DAY - NO 3 day wait (I already had 3 days deducted from my 1st weeks sick-pay)
    NO 13wk assessment!

    I encourage every ESA applicant to request a Group placing at the start (as it states in the actually act).

    I am assuming your breast cancer is now in the past?

    I had a blood clot on my lung which severely damaged the muscle around my lung.

    I cannot even try and imagine your plight with breast cancer but do I assume it has been treated?

    I sincerely hope the cancer has been dealt with for you - everyones worst nightmare

    but if it has been cured surely you are now fit to return to work?

    You've assumed wrong - as G51Shopaholic's breast cancer had sadly metastasised to his/her lung, it will be considered to be incurable.

    Mine has metastasised to my liver but I'm far from dead either. Like others in this situation, I have to keep having treatment to keep things stable until all the available treatments are no longer effective. I'm sorry you are dealing with this rubbish too G51, but it's very encouraging for me to read that you're far from being dead at 3.5 years on - thank you!
