I would not say you are the muppet for paying by paypal, i would say the seller is as they have just left themself wide open to an item not received claim :(

In no way am i saying con the seller out of the money and the item but if the item is faulty or defective and the seller is not playing ball, if it was me i would be tempted to open an item not received case and when i had my money back return the item to the seller so that they have there item back and you have your money back.

I am sorry but that is bad advice. The buyer has already telephoned Paypal for help.

There is a legitimate SNAD claim process that I would follow if it were me. It may just mean a £8-£10 courier charge, but that is small compared to the £599 loss on the cards currently.

    • Claims can only be made for physical goods that can be posted and are not prohibited
    • Buyers must raise a dispute within 45 days of a single PayPal payment for the full price of the item. If no satisfactory response is received from the seller, a claim must be filed within 20 days of raising the dispute
    • Buyers cannot make multiple claims on the same payment
    • Other eligibility requirements apply. See terms and conditions
this is where i got confused thinking that you can only claim for things that could be posted! i told you you would be able to get some good advice! hope u sort it x

You are right, but I would challenge the wording. CAN doesn't mean it HAS TO BE/WERE POSTED. Always worth a try.

Alternatively, you could try your card company, some are helpful others less so. I did have help with a claim for SNAD on a large shed some years ago, £1k worth of Paypal claim. Obviously I didn't want to pay to have it returned. First Direct assisted and with their leverage, I was able to get the seller to sort the matter out.

Edit - forgot to ask the obvious. Was it a business seller? If it was, then you will have other leverage, which will be with legislation rather than Paypal/Credit card companies. There are some excellent consumer rights users on these boards, who will be able to give you the info regarding that avenue.

Agreed bad advice, but thought that the op had already phoned paypal and that paypal had said that because buyer had collected that there was nothing that they could do. i must have misread.

Other than they buyer taking the seller through the small claims court.

Again in no way am i saying con anyone out of money/item.

If paypal have said for the op can open a snad claim, then i would 100% go down that route, yes the op will have to send the item back via trackable method but as you say better to loose £8-£10 rather than £599.
