The bailiff is bluffing. Magistrates court bailiffs don't do that. I'd call his bluff and go to the court and see the judge. They do understand that not everyone can magic up £1600 in 1 day and they'll set a repayment schedule again.

thanks for your advice ... im just not sure any more what is the truth, i feel angry as im the one who collects the post as im through the door first before my partner when i finish work and i know for sure we never recieved any letters to at least warn us of all this. Yet there is no way of proving that as im sure people use that as an excuse so i cant imagine that would go down well. my partners is gutted as hes been trying so hard to clear past debts and to keep up with the regular payments of this fine and then this happens !

    sorry to go on !

PLEASE CALL HERBIE - seriously she's extreemly well known by most bailiffs and she knows a lot of this law BETTER than they do... And often they know it...
IF this were to go back to court then so long as you turn up and defend this the judge shouldn't make your partner pay more than he can afford to. Bailiffs and debt collectors will always try scare you into paying the debts because they get paid on performance same as a sales person... the more debts they collect the more they get paid! Nice huh? :) Way to ensure a lot of people use very naughty methods to collect debts.

STOP worrying but call Herbie as soon as you can - she'll be able to put your mind at rest :)

thanks for your reassurance and help ... the herbie phone number will not be open untill 9am tommrow - will try then. im just also worried that a payment plan will be set up and massive amounts of costs as well added to the final sum if a court hearing again. what we thought we had £900 to pay off as we had been paying it off weekly has already now turned into £1600 almost feels overnight.

thanks so much for your help
