Official Receiver release as trustee.

Hi all, I received a letter from my official receiver today saying she intended to apply to the secretary of business for release as trustee, but her letter doesn't tell me what this means exactly.

I'm assuming it means that she has finished administration, and that her asking for release means I will be soon be moving toward discharge.

Does anybody know what this actually means and how it affects me as the Bankrupt please?

  • For me, this was followed by early discharge a few weeks later. I'm assuming you were offered ED and filled in the questionnaire already? There's no harm in calling the IA to ask. It took some prodding from me to get ED processed, as it seemed to get lost in the cracks between the IA and courts.

    All it means is that they have finished their investigation into your case. It does not mean you will get ED. Have you filled in a new IPOQ for ED or not. Both my wifes and mine investigations were finished at the same time, she went on to get ED whilst I did the full 12 months.

    Thanks for the swift responses.

    I was sent something a month or two back to fill in and send back and it mentioned expediting my discharge, which is why I assumed this was the case. For the life of me though I can't remember exactly what it was.

    Assuming I don't get ED, once the OR is released, what happens next?

    Thanks very much!

    It seems it's simply a case of the admin is done, so now they just make sure everything is OK before moving ahead with discharge, and either everything is straightforward and transparent and I could get early ED, or they want to monitor me for a bit longer and I'll likely get discharge after the year.

    I wonder, if I get ED in a few weeks, would I be able to keep any tax rebate I may have due, or would I still need to declare it?
  • I suggest giving them a call. While they are busy, I've always found them to be helpful.

    From memory the form you will have completed early on in the process allowing the OR to speak with HMRC included a section which allows the OR to claim the rebate even after discharge if it relates to the year in which you are declared BR.
