I don't know if it will help you with a legal claim but when I briefly studied law that was almost exactly the definition of hearsay - you do not have this experience yourself, others have reported it which may or may not make it true. In otherwords you have heard bad things of this company but you yourself have no prima facae evidence. This does not necessarily preclude its use in a civil proceding, but should be viewed for what it is.

What I meant was the owners who told me of their bad experiences was their first hand experience, not that of someone else. If I reported their experiences, then it would be hearsay.

I have heard bad things about them & I've experienced bad things with them, that's enough for me...

I'm not intending to muck about with civil proceedings, it's not worth it for £86. I'm writing a letter of complaint to the chief exec, but I reckon he's the cause of the problem...

..It's not actually hearsay -which implies second hand information, it was the direct personal experiences of many owners who'd used the firm & experienced the shoddy practices of the firm first hand. I also spoke to an ex-employee who had left due to "their terrible business practices"...

That is exactly what hearsay is ;)
second-hand evidence in which the witness is not telling what he/she knows personally, but what others have said to him/her.

    Read my reply #12 ;)

If I reported other owners' experiences or they reported someone else's experience, that would be hearsay. Someone detailing their personal experience to me is not hearsay.

For the person telling their experience, it is not hearsay.
But for you, basing a decision on something you have heard, it is!

    Which was precisely my point.

If I gain information from someone on something of which I have no experience, & submit that as evidence, that is hearsay. Further - if I try to use this information to prove the truth of what I say, that is hearsay. I am doing neither so it's irrelevant. Moreover there are exceptions to the hearsay rule...

Are people on here to discuss money or to argue the toss over ill-understood legal terms?
