Mis-sold insurance

Two and a half years ago I took out a car on finance, I was led to believe that the loan was against the car and I also took out the gap insurance for the car! I have recently been looking into selling my car, when I rang up my finance company to query voluntary surrender I was told that this was not available as my loan is against myself rather than the car! After discovering this it has come to my attention that my gap insurance will not actually be valid as it only covers any outstanding finance against the car (which there obviously is none) as this is the case surely I shouldn't have been sold the insurance in the first place as it is not and has never been valid! How do I go about resolving this and hopefully getting the money back? HELP!!!!!

    I would be very surprised if a dealer was retailing GAP that was not suitable to be used in conjunction with their finance package.

    If it isnt suitable, you of course complain and ask for refund but I suspect your interpretation of what you have is wrong.
