  • I had been on experian not that long ago (maybe a year or so ago) and no such debts were on there, only that all the previous "issues" I had created were being sorted or already sorted but may need to have another look now and see what it sayd - just means signing up again :S

    Should I try sending another letter reiterating the previous and stating I want to see my signature on their copy of the contract to prove it was me? I'm a little worried now that maybe there's been fraud somewhere could this be the case? Though if they felt they had something that they could prove then surely they'd have sent the evidence I was after? So many questions I don't know which route to take. Ignore it, threaten them or ask for more info/proof...

    In your previous thread you said you had been contacted by Lowells?

    You were then advised to send a "prove it" leter to them.

    Who did you send the letter to in the end if you have now received a letter saying it is being padded to Lowells? Presumably the original creditor?

    If you should hear anything more from Lowells then send the "prove it" letter to them. Adding if you like that the original creditor has failed to provide any proof that the debt is owed.

  • thank you. I sent the prove it letters to 3 as it was from them I got the original letters from stating I owed them the money (and that i I didn't pay within 20 days it would be sent to Lowell).

    That was nice of them. Usually they just sell the debt on without any warning at all.

    Your reply to Lowell if they contact you would be as above.

    i.e. "I do not owe this debt. If you cannot prove that I do, then get lost."

    If there anything on your credit reports about this?

  • all I can find on the credit report is my current contract I have from 3 which is up to date and has been with no problems since 10/08/2006...so before these other two were supposidly arranged

    Seeing as you have a current contract, have you rung up 3 to ask what the hell they think they are doing?

    ok, big update. I got the letter back from Lowells/Red with a section "your transactions" and an opening balance, transaction type, credits, Debits and Balance. There are some payments been paid for various amounts, but none of them corrolate to anything from my bank having looked through statements. There was no actual proof that this is from me still yet I am continuing to get letters. Letter says,

    "you recently requested a statement which breaks down the outstanding balance of the debt you owe with Three Mobile."

    ok, umm, no I didn't I asked for proof it was my debt,

    "On the reverse of this letter you can see clearly all the payments made together with a list of the outstanding invoices which result in the balance now due.

    Now we have fulfilled your request we require payment of this outstanding balance. You can either pay the balance in full, or you can pay monthly b Direct Debit at an amount you can afford please complete the direct debit mandate overleaf and return to us within the next 10 days. Alternatvely, please call us and an account manager will be able to take full or part payment by debit or credit card, or set up a monthly payment plan using a variety of payment methods to suit you."

    "As we have now provided the statement as requested we see no reason why you should not repay the balance. As soon as we have full payment, or when you start to repay the balance we will update the credit reference agencies accordingly (where applicable). Having an up to date credit file could help you obtain cheaper forms of credit in the future, If we do not receive payment from you our collections team will assess your account, your credit file and your financial commitments with a view to making recommendations to recover the outstanding balance."

    Oh yes, just to also point out I'm getting a letter a week per debt I "owe" them. The next letter (x2) I received said that further action may be taken to recover the monies owed by me (20th June)

    Next letter (x2) (27th June) said unless I make a payment they will instruct their solicitors to take legal action.

    Those both from Lowell. The next is from Red (4th July)basically asking for the monies else I risk legal action, CCJ's and bailiffs. Two of these as well

    I haven't responded as of yet. I am not going to be threatened or bullied into paying a penny of a debt that is not mine.

    Where do I go from here?
