Gamestation- non delivery.

I purchased a game from Gamestation (online) on the 26th March for delivery to my local store. It was dispatched on the 28th and had and estimated delivery of 2 working days but it still hasn't arrived.

It was originally for my son's birthday on the 4th April. I have made several phone calls to customer services and made several visits to the store, who have no record of the order etc. I have had to buy extra presents to make up for the fact that he didn't have what he wanted as I can't get it in the shops locally.

Gamestation are telling me that I have to wait until the 14th April before I can get a replacement or refund issued and that I have to fill in a Royalmail claim form before they will issue either.

I payed through paypal. Is there anyway I can get the game or my money back sooner?

    If it was delivered to your local store, why are they wanting you to fill in a Royal Mail form ?
    I would talk to paypal and see when you can put in a claim. The ebay board is the best place to post things like this as the paypal experts cluster there :)

    I think it's beacuse it my name on the order but with the stores address. I've visited my local store 3 times in the last week and they're still saying it hasn't arrived.

    Can a consumer cancel an order before they receive the
    goods or where goods are lost in transit?

    3.35 Yes. Where the DSRs give consumers rights to cancel, this right is
    unconditional. If consumers cancel before they have received the
    goods you must refund the total price of the goods, including any
    delivery charges. Consumers who have cancelled under the DSRs
    may refuse to accept delivery of the goods. Refusal in such a
    situation cannot be treated as a breach of contract.

    3.36 Where goods are lost in transit from you to the consumer you will
    need to either send new goods or offer the consumer a full refund,
    including delivery charges.


    So you can just cancel and they have to refund back to paypal. None of this royal mail poppycock

    Oooh, thank you. That's not what the supervisor was just telling me on the phone though. Have you got any idea how long it would take them to issue the refund? They are saying the will give me a refund/replacement but not until the 14th April when it can formally be declared lost in transit.

    Once you've have rejected under DSR, they have 30 days to refund

    I have tried rejecting the undelivered game under the DSR's but Gamestation are still saying they will not refund until I have filled in a Royalmail claim form. I have now opened a Paypal dispute. Hopefully i'll get my money back eventually. :(

    It is utterly ridiculous that they want you to fill in a RM form for an item that was (un)delivered to one of THEIR OWN STORES. Morons.
    Good luck with the paypal claim.

    I don't understand why you have to fill in a claim form, you have no agreement/contract with RoyalMail -- Game do!

    Filing a PayPal claim was probably best, but probably still take another week or so for Game to respond/resolve the issue.
