Oh God

Hello!
It's been a while since I popped up here.
I really need some advice please. Just got home today to a letter from Credit Solutions. It says LEGAL NOTICE, and then goes on to say the Barclaycard can no longer wait for their 9k and legal action may be commenced against me unless I pay them in 7 days. There's no way I can pay. I've been paying £1 per month for 2 years now so I guess my luck has run out. They say I need to call them as writing is no use because their time limits are very strict.
Am I really going to have to go to court?
Please can you advise me? I feel quite sick.

    Possibly. But there is not enough infoprmation to really advise you.

    Do you have a default notice?

    Are your on a mortgage or renting?

    Qyuite simply, do not telephone them. Stuff their deadlines. The only reason for them is because they want to panick you into calling so they can bully you into paying more.

    Thank you for such a swift reply.
    I do have a default notice. I live with my parents as I am a student nurse. I will write to them again and explain my situation - I qualify as a nurse soon and will hopefully be in a position to pay back larger sums each month. This is a never-ending nightmare - I feel so stupid. Good to have confirmation that ringing them won't help.

    What is the debt for?

    You'll only be going to court if you receive a letter from Northampton County Court.

    That's the bulk processing centre for CCJ's.

    Thank you. Could you tell me how it works please? Do I have to physically appear in a court? Does a CCJ just get issued against me? So many questions.

    I've never actually been through it myself, but I don't think you have to physically appear in court.

    There's plenty of info over on the Consumer Action Group website about CCJ's etc.

    As far as I can tell it is designed to panic you - by only giving you 7 days. Also notice it says if you don't pay in 7 days we may commence legal proceedings. It says may - again not a direct threat but a we are trying to scare you letter.
    O.k so they may start legal proceedings but if they did then you could respond to them. What have you got to loose? have you got a house on a mortage or do you just rent? frankly I'm guessing you don't have 7k or probably even 7k's worth of stuff they could take.
    If they do take you to court the liklihood is that they will get a CCJ but you can ask to pay in installments and if your budget is correct it is likely a judge will make your installments the same as what you are currently paying so don't panic. They can't take what you haven't got, they can't put you in prison - frankly most of what they can do is try and scare you into paying but that's about it. IF they take you to court and IF they win and IF the judge lets them then they MAY appoint bailiffs but there are ways and means of dealing with them (I dont' believe you have to let them in but do check) which means frankly all they can do is complain/whinge on at you.

    Yeah, definitely don't worry until you get a letter from Northampton.

    In the meantime just continue to pay them what you can.
