Car not as advertised
Hi all, I bought what I thought was a Seat Leon 1.9tdi SE 130 last month. A few days ago I discovered it may be the 110 model. I fished around to find the 130 has 6 gears, mine has 5. I called 2 seat dealers and based on my reg plate and on the engine code and they say its a 110 too. I called the dealer that sold it to me and he was suprised and said they bought it as a 130 from the BCA and he would call me back. Later that day he called and said they were looking into it and may have to send the car back and refund my money and my px car.
I dont want the old car back, just the details of the model correcting as my insurance have it down as the 130 (higher insurance group), and a small amount of compensation for the trouble.
Where do I stand?

What did it say on the V5?
Have you asked the garage if they will knock some money off for the error?
You have to at leats let the garage try and sort it (which they seem to be doing) before getting a third party involved.0 -
I filled in an online thing with trading standards but not heard anything yet.0

The log book just says its a LEON TDI SE, does not say the bhp. If i type the reg in on moneysupermarket to says 130. The garage won't give me any money unless the get some off the BCA, as they claim they sold it to me without making any profit on it.0 -
It's better to call Consumer Direct, you'll get a quicker answer.0

you might have fire power but under the law all you can insist on is handing the car back and getting your money and old car back (maybe plus any other out of pocket expenses you have incurred)
Anything else is a matter for negotiation between you and the dealer
Good luck with it0 -

Well, it would be fair for him to refund you the difference in price between the 110bhp model and the 130bhp model. You'd just need to negotiate a decent price with him, based on the going rates in your area.
I don't think you have a right to any compensation though.0
