Arrow Global/Wescot

I had a Credit card with MBNA and it was settled in June 2009 in full and final settlement where MBNA paid me a substantial amount to settle the case in full and final settlement as they owed me money and confirmed this in writing on MBNA headed paper and sent me a cheque for the amount they owed me.

Arrow Global then for some reason claimed they had purchased the debt from MBNA even though it had been settled in full and final settlement and asked Fredrickson to pursue me for this debt. I challenged this as the account was closed and showed this debt had been settled and received a letter from Fredrickson in Feb 2010 stating that Arrow Global had asked them to inform me no further action would be taken against me for the account as stated and that the file was closed.

Now some 13 months later in March 2011 Arrow Global have written to me to say they have transferred the same account to Arrow Global Guernsey and asked a debt collector called Westcot to Pursue me. How can they do that when the debt was settled in full and final settlement with MBNA direct and the fact Arrow Global via Fredrickson wrote to me in Feb 2010 to inform me no further action would be taken against me and that the file was closed. Please can anyone advise me if Arrow Global can do this? Can I do anything against Arrow Global or Westcot as they have sent two letters already and I feel they are wasting my time pursuing me for a debt that has been settled. Any comments or advice would be appreciated.

    It seems that Arrow are doing this en mass at the moment.

    i.e. all the debts they have recorded on their systems are being transferred over to their Guernsey based arm.

    Also seems that these letters have been automatically produced without any checks to see whether the debt has been settled or is disputed.

    Either a cock-up their end, or deliberate? Who knows......?

    I contacted both Arrow Global with that email that address 10 days ago and they never replied. I also contacted Westcot and they informed me they had written to Arrow and put the case on hold. My issue is there is no case to answer too, never mind to put it on hold. The two letters sent by Arrow also had my wrong postcode and had the apartment number missing and it was as if they had sent them not wanting me to receive them which makes no sense, unless they are trying to set up an undefended case. Both Arrow Global and Westcot have been sent copies of the settlement letter from MBNA and the letter from Fredrickson stating the case was closed.

  • I received an email today from Westcot who stated they had put the case on hold and have sent a memo to Arrow Global and are waiting for a response. Not sure why they are putting the case on hold when its clearly settled in full and they have the documentation to show this. I have decided not to reply to Wescot as I appear to be just wasting my time.
