About to apply for Bankruptcy

Hi everyone a bit of help needed please.

Myself and my husband are seperating, we have mortgage, seccured loan and quite a bit unseccured borrowing. He works but is on a low income and I have no income we have been advised bankruptcy is the best option.

At the moment I can't afford the fee's but he has the money for his so has printed the forms, we need a bit of help on how to fill them out. Also with reagrds to living costs etc we are a bit confused on what to do. We have both temp moved in with our parents so don't have the usual bills but would hope to soon get somewhere each on our own at some point so what do we put in for the figures?

Also we have a few household appliances such as washing machine etc, are we ok to sell these to try and raise money for fees etc?

Finally we have had some recent visits from court ballifs, am I correct in thinking even if the house is currently empty they cannot force entry and remove anything?

Put down the rent you pay to the parents, food, clothes, phone etc. If you put up the SoA on the board some one will advise you. As long as all the doors and windows are locked then they can't do anything. Have you advised all the utilities you have moved out, given them the readings and got them to cut the services? Have you informed the council you have moved out as well? They should give you 6months CTax free.

    Do the windows need to be locked with a key or just shut?

    Also if we both open a Co-op Cashmindr account now will it be frozen at any point?

    Co-op are very BR friendly and don't freeze the accounts. Just tell them when you open it that you are going BR and let them know when you go to court. You tell the OR that this is the account you run for your daily accounts and he should express no interest in it.

    Just out of interest who is the bailiff collecting for?

    Just make sure you tell the Co-Op why you have the account, i.e as a BR friendly account, and the OR too, then it should be fine to keep on using.

    Can I ask, are you each living with your own parents, as in already living separate lives? If so then you only need to put your own income and living expenses on your SOA, and list all joint debts but only your own individual ones.

    Its Lloyds TSB, so they can't enter if doors are locked and windows shut?

    Yeah he is living with his parents and me with mine but we still have a lot of stuff in the house.

    If your day to day finances are already separate then you fill in your own SOAs without concern for the other's income or expenditure.

    As above, sell what needs to be sold to get the money for your fees. The OR isn't interested in contents unless of a considerable value, over about £1k for an individual item I think.
