You can claim back any charge, not only ones over £12, and you are not claiming the difference between £12 and the whole amount charged. You claim the whole amount. I've claimed back loads of £10 unnauthorised overdraft charges on claims.

You initially ask for the charges (which don't include charges for using cash machines) in your first letter, and in the second letter if they ignore first letter, and if they ignore second letter, THEN you issue a court claim and add the 8% interest on top of what charges you are claiming.

If you mention that you are claiming the 8% interest as well as your charges in your first and second letters, the banks will think you dont know what you are doing and will be more inclined to mess you about. I put in my second letter i was claiming £XXXX but if they didnt pay this amount then i would take them to court where i was going to add on the 8% interest as well as court costs.
