Silly I know but I never checked the online statements.

So u had ppi for 10 years on ur statements and u never noticed/ thought to check ur statements at any stage? You should have known u had it as the bank put it on ur statements. If u didn't check em that's ur fault I'm afraid.

How have Egg "proved" anything? none of their paperwork has any dates on it, someone could have just typed it up for all I know.

I was not on benefits I was in full time employment.

sorry it was di3004 that mentioned benefits not you.

ive previously been an adjudicator at FOS, what PPI_technical_expert said would be correct. your argument also loses crediability as it was 10 years ago.

Thank you for your replies and I see your point, however, it is now 10 years ago that I applied, I began the claim over 2 1/2years ago. Guess I will have to give up on this one.

Jessie15, you really do not have to give up on this one. It has been known that "adjudicators" (like anyone!!) overlook things sometimes and going to the Ombudsman is a choice here if you feel strongly enough.

A decision is sometimes based on "probability" over fact but is arguable if you have more evidence. The Ombudsman service do know that a lot of the old Egg sales were sold online with a pre ticked box and from what people have said they have provided screen shots going back far. Obviously they do not have yours (????? or say they do not!!!) and have used more up to date paperwork and really and truely there is a "slight" probability that they did pre tick your box. If you are adament that they did then you still have the option and do not give up just because some on here tell you so.

egg have countered your argument, proved it was optional and as a non-advised sale, provided you with information to make an informed choice. I doubt Egg would have given your the card if you were only on benefits.
Plenty on here got cards on benefits alone!!!

From what people are saying on this forum, it looks as if alot of the people on here, were with you in the room (looking over your shoulder) when you bought the credit card online. :rotfl:

They also seem to have tracked the adjudicator down and reviewed the evidence themselves. :rotfl:

As I said in my previous post, I would write back to the adjudicator raising the point that the employment dates are out by 10 years. You could say that you've heard Egg sometimes have pre-filled boxes and polietly ask them to check the dates.

I've heard on the grapevine that adjudicators are human beings and occassionally make mistakes! :rotfl:

However if they confirm that it wasn't a pre-ticked box, there's probably not much chance of success.

Jessie15, you go for it, i have won in the same circumstances as you (and i have for other people as well) 2 were over 10 years ago, follow the good advice you have been given on here and you wont go far wrong. I am not saying you are guaranteed a win, but at least you tried and gave it your best shot. Good luck with this.
