Advice needed on CA overpayment
Comments

Hi thanks everyone who posted advice etc. My wife spoke to them the other day and they've said that they'll take a third from her CA per month. It will take 3 years approx to pay off but this away atleast we don't have to find the money ourselves.
still angry that it took them three years to contact us about this, oh well.0 -

The DWP do actually make errors.
These can be hard to spot for those not aware of the exact way the benefit rules work.
If you receive a notice that you've been overpaid, then unless you are completely sure it's actually correct, ask for a detailed breakdown of why, and over what periods you were not entitled.
Check this for obvious factual incorrectness - have they got you down as earning x for a given week, when you actually earned y.
Do not simply blindly assume that it's correct.
In addition to the simple errors of fact - them having your wages down wrong, they can forget to apply the more detailed rules, and simply ask for all you were paid back, rather than the correct amount you were overpaid.
Then there is the case that if it was an overpayment due to official error, it may not be recoverable at all.0 -
No I said that she earned profit share and xmas bonus twice a year which made them months more than her actual allowance she was allowed. My wife is going to contact work to see if she can not have the bonus or profit share. The DWP are now asking her to send her wage slips every three months which is better because it means now they will only pay what they should be paying.nannymiaow wrote: »I thought you said she was over the earnings limit for CA.0
