dla renewal refused

I had my DLA renewal refused, phoned them up to query it, and the advisor wanted to know if I wanted to go straight to Tribunal, or ask for someone else to review it.
Asked if someone else would review it and so far, no letter, but I have had 12 weeks backdated LRC money go into my account today
So very pleased, I get War Pensioners Mobility Supplement, so that's all I expected.
Agree that there is an agenda on at the moment (In my opinion) to just refuse renewals and see if you just accept their decision!Opinions are like bottoms - We all have one, just some stink more than others
Service Attributable Pension - War Pension - War Pensioners Unemployability Supplement - War Pensioners Invalidity Allowance - War Pensioners Comforts Allowance - War Pensioners Mobility Allowance - War Pensioners Child Allowance - Housing Benefit - Council Tax Benefit0 -
I have just renewed my DLA, was due to finish on 01/04/11 but I sent in the renewal form 10 weeks before that date and it got renewed at 5 weeks before the finish date. Went from HRM to HRM and LRC both indefinitely so not all get turned down. All finished in 5 weeks which is the total opposite to what i had been expecting to get after reading sites like this.
Good luck if you appeal0 -
Thankyou everybody,
I went to citizens advice first thing monday, they have appealed, I have written to my consultant explaining to him the situation and asking him if he would write me a letter to take with me to appeal, have informed dla about my appeal and strangeley enough she couldn't find the reason why I was turned down, probably because nobody read my claim form in the first place.
How would your consultant be able to give an unqualified report on what your days are like, some good, some bad and some in between?
How would he be able to assess your mobility problems and/or care needs without him/her actually seeing it for him/herself?
The best you would get would be a confirmation of your condition, what medication you are taking and his opinion based either on what you have told him/her (third hand evidence!) or his/her view of what MAY or COULD happen based on your condition but NOT necessarilly so.
I find it impossible to understand how anybody can give a professional opinion on care needs or mobility problems if they haven't seen it with their own eyes on a day to day basis.
If someone can tell me where I would get this type of evidence that PROVES care needs or mobility problems I would love to know and so would 1000's of others. The evidence has to show that the GP report is a load of rubbish!!0 -
And now to top it all I have been called into the dwp for an office interview, what does that mean0

proberly to check out stuff on the claim form .....on the new re-newals they have changed alot of the wording and new things brought in ...as in low rate care ,can't cut /chop food now has can't use prepared food as well ... and the walking and stumbling has changed too....so really to get anything you have to be in wheel chair 100% and have a live in carer to look after you/feed you ...then you will get something...doctor's have been told to fill in reports differently to ....so you can find that over night the dr. report has cured you of everything , and you can even hear again ..wow ! yes it has stopped alot of liars but a lot of real life needy people do need help with costs to get a near normal life as poss....the truth is out there ... on these pages !!

So ive just spoken to dla, they told me that my file will be back in the office in the next day or so then sent to another decision maker to see if the decision will be overturned, My consultant who has carried out my operations has written me a fantastic report stating that I am unemployable. I also have a report from my gp supporting my case for mobility to be reinstated.0

Good luck Tasha- I too have been turned down after 3 years on high mob and middle care. Social services have told me this government are doing this to most people and I am meeting RAID which is my local DIAL tomorrow who apparently have a 99% rtes of being reinstated. I am terrified as it has a knock on effect of IS which I use to pay the shortfall of rent. As I am in private rental I hold no chance of getting social housing yet I will not get better. I have fibro, sjogren's, sle, tmj.
Let me know how you get on.
I did join benefits and work and filled in what they said and was still turned down so feel frightened and disheartened.0 -
I know how you feel, I dread the postman coming since losing mine, its everything else that gets taken away with it, I have read on here about people who have there cars taken away from them too.0

Thanks Tasha. I am off to RAID no- which is my local Dial after going to the GP. Adult social services are going to call me to see me within the next few weeks. Yesterday I couldn't get down the stairs and the postman came up for me to sign a parcel.. It is people who have good days and bad days which are the difficult ones to assess but with medical records I felt there would be no problem. Saying that looking back- exactly the same thing happened the last time-3 years ago and I got it. It seems worse now as it has a knock on effect on income support....
I will let you know how it goes.0 -
This is the big problem with all the changes the government are making to DLA. The genuine disabled are having to fight tooth and nail to keep their DLA if at all, but the ones that cheat the system are still getting through the system. They unlike us genuine disabled know all the ways to cheat and I also find that a disabled person will always tell you what they CAN do not what they can't.Thanks for any help and advice given
