Fences: am I right in thinking?....

...that I can erect my own back garden fence my side of the original fence my neighbour owns? Currently there is a wobbly 3ft high fence running the length of the garden, it's my neighbours fence and only a few years old but I hate it. I own the beech hedge on the other side of the garden. I'd like a nice 6ft fence between me and her as I like a bit of privacy in the garden. I'd like to put my own fence up in the summer but wanted to check that I didn't need permission to as it would be on my side of the boundary. Am I ok doing that?

    You may erect a fence on your land.

    The only regs I know about are max height in urban areas is 1m on roadside, 2m back garden. Rural areas 2m all round I think. I believe these are by laws in our area, they may differ in your area.

    If you do as you propose next door will probably take down their fence and over time gain a little of your garden.

  • The gain would be negligible probably only a few inches I can deal with that as long as I don't have to see her attention seeking daughter flaunting herself around the garden, it'll be worth it lol! Ta for that!

    Careful you do not undermine his fence by erecting yours otherwise you will be paying for his brand new top of the range, flash as you like new one.

    If you start your fence with a shorter panel, you will be able to have your posts offset from the neighbour's ones. That way, you won't disturb her fence and will able to put your panel close to her posts and will lose the minimum amount of ground.
  • Today said neighbour started tacking sh!te flimsy green trellis to her side in no particular order and it looks awful, makes me even more determined to erect my own now! Thanks for the info folks

    I've crossed this subject twice now.... My fence / Your fence etc.
    In both cases the fences were joint property in the deeds.
    You each need permission from the other, to modify, hang things on etc, of the other party.

    If you want a new fence, ask the other side if you can put a new one up at your own cost on the original line. Might even be greatful?
