Marlin Financial Services and a 10 year old debt.

Well seeing as I have posted my SOA, I thought I would ask this question.

It would seem a tracking agency (Datatrace UK) posted a card through my door last week, I rang them up not knowing what they wanted. I have since found out that a company called Marlin Financial Services have found a 10 year old debt from Yes Car Credit and are looking fror me to pay it back.

10 Years ago the car was taken back to YCC due to a fault with it, I declined getting it fixed, the car was given back to YCC and the debt was written off, ( I have had no contact regarding this debt for over 10 years now)

Marlin Financial Services want me to post my Driving licence to confirm that I am the person that purchased the car 10 years ago. I have not acknowledged that this is my debt.
I have not sent it and from what I have read on here I dont think I should.

No idea what to do now if anything??

Please advise.:T

    It is upto them tp prove you owe the debt not you to disprove
    send them the letter from
    If you are sure it was over 10 years ago and no payment or acknoledgement in the last 6 years in England or Wales, 5 years in Scotland,
    send them the statute barred letter.

    No you shouldn't!

    It's a damn cheek asking for that, and strictly against OFT guidelines.

    Thank you to you both, I have been reading all the posts on Marlin Finance and will be sending the "prove it's my debt" letter first.

    It would seem that they are not sure that it is me they are refering to regarding this debt to hence the proof of signature they request via my driving licence, and I have not acknowledged that it was me in the first place.
    They even said they would get the police envolved to look into the matter of someone claiming to be me who bought the car and forging my signature. I was up for this as I honestly couldn't remember getting this car. I really thought someone had bought a car posing as me. lol how daft am I?

    Having thought about it, yeah I did buy the car, (I gave it back and was told the debt had been written off) but not at the place they said I bought it, hence why I quibbled that it was me they were looking for. But regardless of that, this debt is 10 years old for sure.

    I feel I should wait for them to send the first correspondence in this matter. I will not be answering there phone calls.

    As that would appear to be a misuse of your driver's licence, you should report those jerks to the DVLA.

    As the alleged debt is over six years old and therefore statute barred by section 5 of the Limitation Act 1980, you might wish to refer Marlin to the celebrated retort in the matter of Arkell v. Pressdram.

    I will be getting on to the DVLA about the matter. Underhand tactics like this should be stopped.

    How will this affect my Credit Score...meaning if the debt is Statute Barred, would they have gone poking around my credit file??

    It should not affect your credit score in the least, though one might perhaps slightly doubt the wisdom of anyone who once used Yes Car Credit. :p

    Oh, don't believe a word of anything they say about the Police! Marlin and similar outfits never want your ID documents in order to do YOU a favour, and it's ironic they mentioned forgery, as some DCAs have been known to get creative themselves with any supplied details and signatures in order to magically produce 'original' documents 'proving' you owe a debt...

    Anyway, they have to do all the proving you are the debtor part, not you, so as you were - 'Prove It' letter first ;)
