sold car privatly legal rights?

hiya hoping someone could give me advice as iv got no voice ATM so cant call citizens advice.

my partner sold his car yesterday privatly to a man who was a dealer, after 4 hours of him having the car he texted my partner saying the car had been in a previous accident and had been resprayed and tht he wanted £600 back or us to take the car back. the log book was sent off straight away when the man purchased it at below its value anyway. As far as we are aware the car hasnt had an accident as we purchased it from vauxhall dealer with clear HPI also the man done HPI check before he purchased. he is now threatening with legal action if we dont give him the £600 back or take the car back. What are our rights?

    So you as a layperson sold a car to an expert and he failed to notice something that you were not aware of. Refer him to the answer given in Arkell and Pressdram ;)http://jackofkent.blogspot.com/2010/05/reply-given-in-arkell-v-pressdram.html

  • thanks. just got worried when i saw on citizens advice that if it wasnt as described they can go court but we didnt say either way but it was hpi clear from our purchase till time of sale.

    I actually have a slight warm feeling inside, knowing that a dealer got his fingers burned for once, instead of the other way around.

    Put it this way, if he'd sold you a car that later on turned out to be a lemon, he'd tell you to jog on as well.

    Sounds like a new scam to me. Someone in trade buys car, then looks at it and tries to get his money back. Maybe wishful thinking for all the punters who've tried it on in the past? He can't be serious, tell him to go away.

    Why did the reg dog get sent off is the buyer was a Dealer? Surely the Dealer would want to keep hold of the docs so he could sell it on again? unless he was pretending to be a dealer.

    Either way, more fool him for not doing a HPi check...
  • He did do HPI check and came back clear as it did when we brought it. We sent off the yellow bit and he has the green part x

    You send off section 9 when selling to a dealer/motor trader.
  • dunno what section it was but was the yellow part for a dealer and he keeps the rest, but obviously sending the yellow part gives him the ownership of the car. We cannot take the car back as we havent got the funds to do so now we have purchased another car.
