House insurance claim query

Hello,
Looking for some advice for our situation.

We claimed in Dec 2009 for a water leak - water coming through our kitchen ceiling from the bathroom above. The claim went ahead & the whole ceiling was removed & the bathroom ripped out & reinstalled. Apparently the leak had always been there since we'd move in.

Since then we've renewed insurance with a new company (Swinton) and are having the exact same problems - water coming through the ceiling - it appears that the original leak has never been sorted. The company that was used to do the repairs in Dec09 has gone bust so doesn't exisit anymore! Can or should we claim again from the new insurance company?

Thanks for any guidance.

    Nightmare. Arguably the original insurers should be paying for the claim and looking to subsequently claim from the liability insurers of the people who "fixed" it. I'm guessing.
  • thanks - the company who did the repairs told us it was under guarantee for 12 months - obviously it's over 12 months and they dont exist anymore! do you think i should contact our previous insurers then?

    Was it a cash settlement or did the insurance company arrange a contractor?
  • they arranged a contractor - their preferred contractor a local company who have recently gone into receivership....

    Just go back to your previous insurer, they arranged the contractor, they should retain some liability I would imagine.

    I can't see your new insurer dealing with it.
  • thank you - i will get in touch with them tomorrow & hope we get somewhere... could really do without it! so disappointing to have this all over again, my son asked why there was a shower in the kitchen!

    You should probably tell your existing insurer about the situation. It shouldn't have affected their ability to insure you, but in good faith you should let them know.
