    I think it means that your landlord should not have rented you the property, knowing it would mean you'd be overcrowded. So he is contravening the above act. Therefore if you just up and left, he wouldn't have a leg to stand on - I think.

    Are you really overcrowded though. The guidelines include living areas in the calculation. Example a 3 bed terraced house with a lounge at the front and a dining room in the middle on the ground floor with the kitchen at the back would count as a 5 roomed house. You could have up to 2 adults and 16 children aged under 10 but over 1 in it. Kids count as half and it's 2 whole people per room. So 2 adults in 1 room then 4 rooms remain which can have 8 whole people which makes 16 children.

    It may be likely you have a really small 2 roomed house. A single bedroom and a single living area which can house 3 adults or 2 adults and 2 children according to the table provided.

    Very few houses are really overcrowded in that sense.
