OPC Guilty and Fined

I understand that OPC (Observices Parking Consultancy) was fined yesterday over £30,000 plus costs and the Director Mr.Harris was fined over £5,000 plus costs.

This follows action taken by Wolverhampton Trading Standards.

OPC were prosecuted under the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) and Companies (Trading Disclosure) Regulations 2008 CdtRs. They pleaded guilty to 2 charges relating to professional diligence, 1 relating to delays in acquiring drivers details from DVLA in breach of the British Parking Assoc Code and 1 relating to misleading signage on site, Reg 3 CPRs.

They pleaded to 8 charges of Misleading Actions relating to turning down appeals supported by evidence and missing vehicles that left the car park and returned later but did not exceed the 2 hour limit, reg 5 CPRs.

They pleaded to 2 charges of Misleading Ommission by failing to inform a driver as to the identity of a 'debt collection business' that was part of their own organisation, Reg 6 CPRs. They also pleaded guilty to 10 charges of failing to properly disclose the legal identity of their debt recovery arm to drivers, Reg 6&7CdtRs.

    Love it, it's a shame they didn't get prison though.

    I hope Harris can't afford to pay then ends up having the bailiff's knocking or ends up in the nick.

    I wonder why they did not use Part 8 of the Enterprise Act and so create an Enforcement Order.

    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I know the court was not dealing with the legality of the tickets themselves, but there seems to be an implied acceptance the company can issue tickets and fines.

    This is very regrettable.

    Well there has been an implied acceptance that a PPC can issue invoices (not fines!) , any company can issue invoices, but whether they have any merit is up to a court to decide, plenty of courts have actually thrown out the PPCs cases because they are in fact a penalty!
