Maniac886 V Shabbey...advice wanted!

This is what I have done so far;

1. Obtained all my statements through DPA request and calculated charges of £366.

2. Sent off prelim and got a reply within 14 days saying they would refund £80 as GOGW.

3. I accepted the £80 but asked for the remaining monies to be refunded within 14 days, written in my LBA.

4. Will fill a claim via money claim on 29/11 if they dont respond.

I just have one question. This account is a student account so I am not charged interest. Does that mean I should remove the section on 8% interest when filling the claim online?

    If you issue a court claim, you can still add the 8% interest. This is nothing to do with the type of bank account you hold (and nothing to do with reclaiming bank charges specifically). It is your right when you issue a claim in your county court (small claims) to charge interest at 8% on the amount you are claiming.

    I am happy with just claming the £286 I am owed... maybe the banks will pay quicker if i dont stick the 8% on. :confused:

    It'll make no difference to the bank whether you claim for the interest or not (you are talking about relative pennies to the bank). They won't think along the lines of........'he never claimed the 8% interest he was entitled to so we'll deal quicker'. The bank already knew that you were entitled to add interest at the court stage, but still they let you get to this stage.

    I don't know why you would think along the lines of saving the bank any money. They had no qualms with adding unlawful charges to your account in the past.
