in IVA & DRO
Hi this is my first post and probably going to be a long one.
I completed my IVA in march 2010 and am in the process of clearing my credit file. All defaults associated with the IVA have now been removed after much work on my part. I contacted all of the CRA's and sent them a copy of my completion letter asking them to remove all information regarding my IVA.
Equifax - removed straight away
Experian - have had my copy in their hands since 9th March and still not removed.
Callcredit - have had copy since 18th march, not responding to emails and very rude on the phone...will not even confrim that they have recieved my letter.
I also recently checked the insolvency register and found that my name was still on the register ( it should have been removed around june 2010!!). I then contacted my IP to ask them why my name was still on the register and they said they would send the info to them again!!
That was over a week ago and my name still appears so I called them again yesterday and was told it would be dealt with straight away!!
After weeks of phonecall, letters & emails experian told me today that they are NOT removing the IVA entry on my file because my name still appears on the insolvency register!!!
Fuming does not cover what I am feeling at the moment!! I have contacted the insolvency service and they have told me that I now have to send a copy of my completion letter to them!! I could just cry at the moment...I feel like after fighting with these people for weeks...believeing that I am getting somewhere...I am now back to square one Surely It was my IP's responsibilty to remove the entry from the insolvency register?? I am now beginning to think that if they had done their job properly in the first instance I would'nt have to be doing all this now. It is odd's on that Callcredit are now going to come back with the same answer!!!
I am mentally exhausted by all this and feel beaten at the moment:(
I keep getting told that there is a 28 day turn around on removing entries...am I now going to have to wait another 28 days for the CRA's to update my file once my name is removed from the register??
The situation is becoming really urgent now as I have applied for the right to buy my council house and my 12 weeks to accept the valuation is up on the 15th of April...then I will have to go through the entire process again!!!
Any advice as to what to do next would be much appreciated.

Hmmm ... as I understand it the reference to the IVA will stay on your credit file until 6 years from the date of acceptance of ther IVA ( assuming that you have got all the creditors to amend any default dates to that date). As for the Insolvency Register -- I think they are still having difficulties adding and removing entries at the moment. Save your IP ( or you) sending copies of the completion letter, there is little that can be done at this end.
So, assumimg an IVA start date of march 2005, and correct default dates, the reference to the IVA at the CRA's should be dropping off anyday soon in any event.
Fingers crossed.0 -
Thanks for your input foggy.
The 6 year mark passed on March 1st, most defaults came off automatically but a couple of them were given after the start of the IVA so I had to get the creditors in question to update the information which took a couple of weeks but they came off last week. The entry on the insolvency register should have been removed no later than 3 months after the completion of my IVA ( Iva completed on march 1st 2010 so entry on register should not have appeared after June 1st 2010 at the very latest).
CRA's are saying that they will NOT remove IVA info on my file because the Register is still showing my IVA as " active"!! which it obviously is'nt.
Even if the insolvency service are having problems with adding/removing entries, surely it would not cause a delay of 9 months!!0 -
Sounds like there's a problem with the insolvency feed. Active IVAs are retained until completion. If you've sent us your completion letter we will remove the IVA if it's over six years old. As you need to sort this quickly, please get in touch with us using the link on my biog and we'll try to expedite this for you.
