LSAP Help please.

My husband & I are recently married & he's been in the army for just over 4 years.
I live in the house I bought with my previous partner 6 years ago with my daughter.
My ex's name is still on the mortgage with my name as when we split, I didnt earn enough 'on paper' to take the mortgage on alone.
We have a court order in place that he signed all rights over to me meaning that he can't get any equity from the house etc.
We have tried to get my husbands name on the mortgage, which I never dreamed would be a problem with his job & I work part time. From when my ex left I paid the mortgage myself & have never ever lapsed or been short.
We can now afford to overpay so we have been doing that (£120 a month extra) which has taken 12 years off the mortgage term (obviously interest rates variable) but even so, we are about £2k short a year for my husband to go on!!!
I was dumbstruck by this as we can more than afford the mortgage plus pay extra & the only other debt we have is a bank loan that my husband took out of £9800 to buy his car last Nov.
We dont have enough equity or savings to remortgage so were kind of stuck on that front.
We had also gone to ask about borrowing extra on mortgage (which was obviously a big fat resounding NO) as we desperately need a new roof & a full rewire (we have a little old terraced house with 1950's wiring which is 'leaking' half an amp electricty permanently, costing us & totally wasting our money which is why we need the rewire). We also need a stud wall putting in the bathroom cos of damp & then we'll need to redecorate throughout after the rewire. We then plan to rent the house out & move into married quarters as my husband is based 180 odd miles away (just over 3 hours drive away). We plan to move into MQ early next year.
So back to my original question (sorry for waffling!!!), would we be eligable for LSAP to do home improvements (we have heard conflicting info), if we are, would that only be if my husband was also on the mortgage and lastly, if all that was ok, would we still be able to get the LSAP then rent the house out & get a married quarter??

    JSP 752 states that

    The aim of Long Service Advance of Pay (LSAP) is two fold:

    a. To assist eligible personnel to enter the UK housing market; and/or

    b. To help meet UK housing needs arising from changing personal circumstances during an applicant’s Service career.

    There are situations were it can be used for extensions and the like but they revolve around medical or family needs. So I cannot see that your husband would be entitled to claim it in the circumstances.
  • Why not sell up, let someone else have all the hassle of getting the work done, and move into a quarter now? Can you clear the mortgage with the likely sale proceeds?

    You can also claim LSAP for security reasons / upgrades. Say you cannot close windows or the doors are falling off etc etc.

    But for renovation it is not possible.

    Thanks for the replies.

    We dont want to sell up. In order to leave the work for someone to do would mean that we would have to drop the price, which would probably result in us only just breaking even. Besides, houses just aren't moving around here.
    The main reason though is that by keeping the house, it is a 'security net' for me should I not like it in the MQ.
    I doubt that that will be the case as we cant wait to be a family living together properly & I always make the most of things but its nice to have something to fall back on

    Again, thanks for the replies. My husband went to see the clerk but he didnt know much so advised him to see FSA. He didnt get chance so he called Glasgow (JPAC) directly.
    They say that there shouldn't be a problem with us getting LSAP for the work we need doing. Afterall, it is safety too.....u need a hard hat just outside the house whenever theres a bit of wind as the roof tiles keep falling off lol. The rewire needs doing as not only is it leaking the half amp permantly but often when you pull a plug out, theres a blue spark of electricity & then the stud wall needs doing for the mould as this in itself can be a health issue especially for asthmatics like myself.
    The only problem is, he has to have his name on the mortgage or he cant even apply.
    So it all goes back to that aarrgghhhh!

    I know what the article is for LSAP, I meant more specifically for the 'security reasons'.

    No where in the JSP 752 Chapter 2 Section 4 does it say, you can use LSAP for 'secuirty reasons'.

    I think the other poster is confusing this paragraph:
    Building Work to an Existing Property. Where application is made for building work to make a property fully habitable, or an extension to an existing property to meet extenuating medical/family circumstances, the application must be supported with relevant evidence. For example, a solicitor’s letter, a medical certificate, surveyor’s report and plans of the existing property and proposed building work. LSAP cannot be used to cosmetically modernise a property. For example, to update a kitchen or bathroom suite where the existing one is deemed fit for purpose.

    I fully agree with fergie76, that is the paragraph I was refering to when I mentioned "medical or family needs".

    Unless there is a hidden update to the JSP somewhere I don't see how LSAP can apply to this situation, and given all the cutting of other allowances I cannot see it changing.

    02.0405. Property Owner. A Service applicant is deemed to be a property owner if, by virtue of purchase, inheritance, gift or other circumstance, their name appears on the deeds of a property.


    You say he's not on the mortgage, so is he on "the deeds"?
