Car phone warehouse lost phone

Hi please could you give me some advise as to where we go from here. Just spent an hour and half again at the local CPW desperate to resolve where a phone is that went for repair some 5 weeks ago. The contract was barely 3 months old and the phone stopped working so went off for repair. Was contacted to collect the phone only to ne told by staff that the fault seemed to be still there and would again have to be returned. No sign of the phone :mad:
According to their handbook if a fault occurs within 30 days of return from repair a mobile phone will be replaced :rotfl::rotfl: No sign of said phone and it has now been 'lost in transit'
Fine then just give me a replacement :rotfl::rotfl:
Another hour on the phone to repairs and customer support (need that department name changing) and nothing. The store manager was even dismissed with no one coming up with an answer.
Just rung CS again and there is no second repair sheet from the store to be found so it looks like somebody is really trying it on and we are still without a phone and paying monthly for the privilege.
Rang SIM have assured me this is common practice with CPW and constantly 'fob' people off.
I can't come out of the contract and have a feeling that the said phone may have never been sent off for repair and could 'appear' tomorrow:exclamati
