Apple Ipod touch - Help please

Hi I bought an apple ipod touch 1st gen 16gb in June 2009. In August 2010 the battery died a death. When I took it back to Apple they told me no problem they would replace the battery for £50 which i paid with a 3 month guarantee. About 3 weeks ago the battery died again, again i went back to Apple who informed me that because i was outside the 3 month guarantee I would have to pay another £50.
Does this sound acceptable, I am not sure how the sale of goods act works with this as I would have paid £100 in just over 6 months.
Anyone had a similar problem

As it is now over six months since your bought the replacement battery, the onus is on you to prove that the battery is inherently faulty.
I imagine that will be difficult to find anyone to confirm that the battery was faulty at the time of sale.0 -
It is a 3-month guarantee. After that, you are on your own to fix any problem your product has, so I guess there's not much you can do.0

But generally speaking, if a product fails in the first six months after purchase, it can be assumed faulty at the time of purchase.
It is for the seller to prove otherwise.

Have you tried contacting apple?
I know a few people who have had issues with ipods and have went directly to apple and received a great response. Not sure whether they were lucky or its the norm thoughYou keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
My son got a brand new replacement ipod touch from Apple, with the same specs for £59 when his one stopped working. His was a 1st gen one and the replacement was also a 1st gen - but it was still a new one, not a refurb. I can't remember how much guarantee he got with it though.0

The OP told us that they had been in touch with Apple, and it was Apple that refused the free second replacement.
Bleh i meant apple store sorry :X One person i know bought online but contacted his local apple store and they were more than helpful.
OP, did you buy it from apple? If so did you buy it online or in store? If you bought online and havent tried instore, try and see what they say. If you bought in store and havent tried customer services, try that.
My own one i've had just under a year and the battery life is nowhere near what it used to be. I suspect i'll have to get a new one myself shortly :XYou keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Thanks I got the replacement from the Apple Store, I have contacted Apple on line customer care and will keep my fingers crossed.

If they say no to a replacement you could always try (perhaps cheeky but if you dont ask you dont get!) a goodwill discount off your upgrade. No it was the special offer from 02 when they had a clearout.
