Ipod Touch 1st Gen Advice please

Hi I bought an apple ipod touch 1st gen 16gb in June 2009. In August 2010 the battery died a death. When I took it back to Apple they told me no problem they would replace the battery for £50 which i paid with a 3 month guarantee. About 3 weeks ago the battery died again, again i went back to Apple who informed me that because i was outside the 3 month guarantee I would have to pay another £50.
Does this sound acceptable, I am not sure how the sale of goods act works with this as I would have paid £100 in just over 6 months.
Anyone had a similar problem

Nope. I assume the battery they used to replace it was new.
I would invoke the SoGA stating that the battery is not of a satisfactory quality, that is, that the goods meet the standard that a reasonable person would regard as satisfactory taking into account the way they are described, their price, and any other relevant circumstances, such as the fact that they are second-hand or used. If a product that was not of satisfactory quality at the time of the sale is returned to the retailer, the buyer is entitled to a full refund (if it is within a reasonable time of the sale), or, if a “reasonable time “ has elapsed, to a reasonable amount of compensation, or to have the goods repaired. The consumer needs to demonstrate the goods were not of satisfactory quality at the time of sale. This is so if the consumer chooses to request an immediate refund or compensation. It is also the case for any product returned more than six months after the date of sale.0 -
I have a 1st generation iPod Touch with the original battery and it works just fine. So either the replacement battery was defective, 6 months is not of merchantable quality, or the iPod itself is defective and they have not diagnosed it properly. 3 months guarantee for a unit that originally had one year is not sufficient for the price paid.
Try another Apple Store if possible or take it back and ask to see a manager and say you don't think that the repair was satisfactory especially in 6 months. Do not be aggressive but do say you are not at all happy and expect better treatment from a company like Apple. This has been known to work in the past.~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
