Section 75 question

I recently bought a new TV online and used my credit card so that I would be protected. I have the money and intended to pay it off in full but now I am wondering if paying off the balance means I am no longer protected?

Should I wait until the TV is delivered and confirmed in full working order etc?

No - it makes no difference - you would still be covered once the item is paid off your credit card.

Thanks for that, I had hoped that would be the case.

Be aware you only have coverage if the company goes out of business or doesn't delivery.
It's not a warranty against defects unless the card offers this an an extra. Some cards do offer warranties but it's not part of the statutory section 75 protection.

That isn't correct, if the retailer has a liability (under Sales of Goods Act, Distance Selling Regs etc. etc.) then the credit card company has a liability if you meet the criteria for Section 75 (wich yo should do)

Note also, section 75 unfortunately doesn't cover you if there's jack all to watch, and the only thing on is re runs of Judge Judy.
  • I have received the goods and returned them and now the company has gone bust. Am I covered under section 75 for a refund from the credit card company rather than the adminstrator?

Specifically, you're covered for 'misrepresentation' and/or 'breach of contract'.
  • Breach of contract meaning that they have received the items, but not refunded as per their terms and conditions?
