Private sale car deposit, where do i stand?

Hi,
I viewed a privately owned car this week fully aware it was a category d. After test driving we negotiated a price on the car and that the full amount would be handed over on pick up of the car on the terms that the full service history of the car had been seen by me and the report on the bodywork of the accident repair had been sent to me. I recieved the report from the guy but it was only a diagnostic report from the on board computer saying the car needed a new battery and absolutely nothing about the bodywork where it had been repaired. This was not satisfactory for my insurers. I was told i needed an AA inspection so began to arrange this, just before shedding out 170 pounds i was told by AA they would not view due to it being a write off. I carried out a car check with them to find out that the car was actualy a category C write off and that it shouldnt even be on the road due to it having not been inspected! I rung the seller politely asking for my money back asap which he agreed to but have not received the money nor heard anymore from the seller since. I have a written receipt saying that the deposit had been taken under the conditions discussed and with both mine and the sellers signature. Where do i stand in this situation guys? I'd really like my money back!
