You are entitled to the benefits even though you aren't the legal guardian however you have to get the mother to rescind them. My parents looked after a family friends daughter for a couple of years when she couldn't cope.

Thank you for this... should I just enquire at the child benefit agency in Newcastle ?

first of all you need to tell the authorities she lives with you, its a legal requirement, then you should be able to claim as you are the legal guardian then or the mother will have to have her back or a payment arrangement between the 2 of you will have to be made.

you should put in a claim for child benefit. just give the helpline a call. or if under 16 you can get form on hmrc website.

You are what is called "Private fostering arrangement". You have a duty to let your social services department know obviously what the arrangement is. they can also firm up your need to recieve regular maintainence for the child as well. ( plus check you are not an axe murderer/ rose west type :o)

As Lynzpower has mentioned you need to inform your local SSD, this applies to anyone who cares for a child who is not related for a period longer than 30 days. Some people may be concerned about contacting SSD, however it can make the process of both claiming correct benefits and providing a child with stability that bit easier.

have red your post and im in a similar situation, i have had someone living with me for a year and her mother hasnt paid anything towards her keep although is claiming benefits. She has just turned 16 and wants to go to college but her mum refuses to fund this and i can no longer afford to do it. I have been to social services today and they adviced me to report her for fraud and claim myself but im not sure as i can do this as she is not my child. Could you let me know how you got on, thanks
