Cancel order because items haven't arrived?

Hi all,

I order a couple of items on the 24th feb from a .co.uk website (but which is based in Switzerland).

They charged my card immediately, my order still shows as processing on their website as the items are still not in stock.

I have asked to cancel my order and for them to refund my money, but as yet, I have heard nothing back from them.

Under what regulations do I have protection? Am I covered by Distance Sellings (as you can cancel up to 7 days AFTER receiving a product)? Would this actually be of any use as they are a Swiss company?

    check whether switzerland are in the EU or EEA

    Check the DSRs to see whether it applies to the EU or EEA. The full title of the law is THE CONSUMER PROTECTION (FISTANCE SELLING) REGULATIONS 2000.

    Switzerland are not in the EU or EEA..

    cost of items were ~£34.. so I presume I can't go to my CC provider for help?

    You can try. they are only obliged to help you for breaches on contract for amounts over £100.

    That is for S75, if the card is VISA then they can do a chargeback, see WHICH Addendum

    "Addendum: This Visa Chargeback Scheme also applies to Visa Credit Cards"
