Daniels silverman court action

My wife received letters a few weeks ago about a parking ticket for illegally parking by a private parking company, we looked at some other forums and she sent a letter to daniel silverman saying that she wasn't the driver and sent them a letter.They have replied back saying they have attatched photographic evidence or our car parked which was not with the letter,also they have noted that parts of the letter were copied from an internet site and that as the car was parked without an authorised permit, that she as as the owner of the vehicle must know who the driver was and if not then she will be providing false information, since she she did not report the vehicle as stolen.
Now she has a letter with notice of court action to now pay £281.52. now she is getting a little bit worried, what should we do?

    I am a little consufed, did you say you appealed against this as I didnt think Daniels Silvermann where a parking company.
    £281.52 does seem like alotof money, when did they say it was issued and are they trying to charge you £3 per day or other amounts we hear about ?
    Where was this issued, council carpark - have you contacted the place it was issued.

    Ignore them. First and foremost you are not legally obliged to tell them who the driver was.
    Secondly as I read it your wife has simply said it wasn't her NOT that she doesn't know who it was.
    Thirdly despite what they will tell you ,you don't have to know who a specific driver was at any given time.

    You should not have written to them at all , as now they will bombard you with all sorts of threatening letters full of pure bull**** about your legal obligations and the consequences etc.

    get this in your head ..these people will tell lies to get you to pay up ..ignore them ..but if you have any specific questions about any legal lies they are telling post back here and there are plenty of members who will be able to explain exactly why what they are telling you is not true.
    Did I mention that these people tell LIES in their letters ?
    (ALLEGEDLY of course lol..wouldn't want them suing me for libel lol)

    Why worry about that load of codswallop? :p

    Obviously you don't have to report your car stolen every time someone other than the owner drives it - and neither do you have to tell Daniels Silverman who was driving. Nor do you have a duty to know or keep a record of who was driving the car and when!

    No crime has been committed, you must ignore this whole generic scam. What made you think you 'ought to' reply to them? We clearly tell everyone to ignore the whole letter-chain thing - it's just standard threatograms. Other forums say the same:

    If you are up for it please collect the Daniels Silverman threatograms to add in due course to our top thread 'PPC letters, what to expect'. We have had people tell us about DS letters before but I don't think we have picture examples yet - please could you help complete the info? If you pm the pics to Crabman, the top thread OP, he can check that you've removed all ID details before the pics get added to the thread.

    Are you sure that this is the exact meaning of the words they used ?

    If it is then there are grounds for serious complaints.
    Perhaps we could see the exact wording (sans personal information of course).
  • No the ticket was issued by aumberry parking management who said the fine was £75 if paid within 14 days , and as we did not reply to them we then got a letter from daniels silverman acting on aumberry behalf telling us we have to pay £150 as the car was parked without a permit.We again did not reply to them but they then rang my wife on her mobile, but we never gave them her number and i then rang them and told them to stop harrassing my wife. At which time the person i spoke to said that my wife as the owner had to say who the driver was. Then i wrote to them and used a letter from another website just saying that they were harrassing us.Then another letter a final demand for £200.93 and once again threatening court action if we didn't pay.Then on the 8th of march a letter from daniels silverman notice of court action saying that as we have not replied to them then now they have no alternative but to issue court action against my wife and that legal papers are being drafted, the fine is now £281.52.Then on the 10th of march a letter saying that they have attatched photographic evidence of our car parked in aumberry car park without a valid permit(no photo was in the letter) and the letter continued
    'if you state you were not the driver you must know who was driving your vehicle and if you deny this then you will be providing false information since the vehicle was not reported as stolen.We have also noted that parts of your correspondence has been copied from an internet site'.

    I know now that we should not have written to them but when my wife is getting letters and phone calls she was getting worried and ignoring them did not seem to be working.

    If they should ring again, make sure you and your wife are ready to tell them the alleged debt is denied and that you have quite a file on them for harassment. Tell them to stop contacting you as they are breaching the Protection from Harassment Act:

    But if it's just letters keep ignoring them. Do not contact them in any form.

    If you want to sue them for harassment then the info is on that link - please do at least complain to the right places (OfT, TS, MP, press, Retail Management at the car park) as this treatment of you is outrageous after you have already stated they are harassing you!

    Depends on what it is for, they have no powers except to ask for payment, unless they own the debt they are chasing! Are they just sending you the "please contact/ring us" letters?

    If it is a legitimate debt there is always the chance they instruct the originators to apply for a CCJ. Or them if they own the debt!

    If you know what its about it may be best to deal with it, just don't be bullied by them! They can do very little except being a nuisance!

    Parking charges can be ignored because they don't exist except in their mind!!
