Reselling Amazon items directly on ebay - is it legal?

    What annoys me the most is that this seller was taking the pixx by listing something that he did not have in stock.

    As I said before a neg is warranted if someone lists an item they don't have in stock. Listing Amazon's items that are not in their hands is just not on, how do they know they are going to be able to get hold of one when they need it?

    If the item was sold out for the OP, it was also sold out for the seller.

    There seem to be two distinctively opposing viewpoints.

    Either you believe:
    • The seller genuinely had the item and despatched it promptly, which disappeared en route and the seller provided a replacement at their own cost, coincidentally at a cheaper price.
    Or
    • The seller falsely claimed to have the item and to have despatched it. Then falsely claimed it disappeared en route and simply bought a replacement at a cheaper price when available and kept the difference in price as profit.
    Personally, I think the latter far more likely. However, if the seller genuinely despatched the item, they will be able to show some evidence in the form of a proof of despatch. Before leaving negative feedback, why not ask them to supply it? If they refuse, there can be little doubt which version of events is the true one! :)

    I know this thread is a month old, but I was just about to post a comment about the same thing. I recently ordered a Wii game off Amazon, paid by paypal, and the next day the seller cancelled the auction & refunded my money, saying I was welcome to purchase from his updated listing (at a higher price!!!).

    After looking more carefully through the seller's feedback, it became obvious he/she is dropshipping through Amazon. Several buyers have left negs for this reason (item comes direct from Amazon) - and several negs because seller cancels auction as in my case.

    I refused the cancellation request and reported to eBay, who responded promptly but can't tell me what action they have taken (if any). however, eBay do say that the seller breached the 'non-performance policy'.

    While I realise that dropshipping is not against eBay rules, i do think it should be made clear on the auction that the item will be 'dropshipped' so that the buyer can make an informed choice. In my case, the eBay item was much cheaper than the one on Amazon, which is why I chose it (yes! I did do my research!!!). But the seller had obviously made a mistake. He/she is also charging nearly 3x the Amazon marketplace postage for the same item.

    All in all, it puts me off using eBay... I used to buy and sell a lot on there, but not anymore.

    My sympathy lies with the OP in this thread. As a buyer, you need to know where you stand.

    h.cowell. In your example the seller will struggle to sell much longer on ebay , so it is not an issue. If they have negs then surely people will stop buying, and if they have seller non performing strikes from ebay they will get suspended.

    I trust you left a well worded neg and stars that reflect your experience .

    Thanks soolin, I left a very factual neg for the seller :-). I just wish I'd looked through the seller's negs more carefully before buying, but he/she has almost 99% +ve feedback and that was what I factored in. Almost all the negs seem to come from the drop shipping aspect though, so would have alerted me if I'd read them...

    I'd advise others to look carefully at feedback before buying!
