Selling a house with no deeds?

Found this reply to a similar question (probate property to sell, no deeds found anywhere) and just wanted to check that it was right (can't check LR site on a Sunday for some reason)

My late mother's house was bought by her in 2005 so going on the reply below, there are no deeds anyway but that doesn't matter?

Would make sense as my mother was a record-keeper so to not have something as important as deeds to the property would seem strange

"The first thing to check is whether the house is registered, on the Land Registry web site. If it is, this is the definitive record of ownership, so there will be no deeds. All properties will be registered if sold or mortgaged since 1990. Before that the registration system was phased in gradually since 1926, so depending where you are it may still be registered even if your mum had it much longer than that.

If it is not registered the deeds will most likely be in 1 of 3 places. Either with the most recent (or current) mortgage lender, or with your mother's solicitor, or the one who dealt with the last purchase, or with your mother's bank. Tracking the solicitor might be a problem, but you can contact the Law Society or Solicitor's Regulation Authority for help.


If the deeds cannot be found it is possible to register the property without them. Check the Land Registry web site for details.


Edit:

To clarify: The house is EITHER registered, in which case the Land Registry hold the definitive record of ownership and there are no deeds, OR it is not registered, in which case the record of ownership is the deeds, and the Land Registry will have no records at all."

    yout understanding is correct

    if the house was purcased in 2005 then the definitive records of owenership will be held electronically by the land registry

    assuming the house was originally registered with LR then the fact the paper deeds have been mislaid is irrelevant, if however the house was not registered then as you say the paper deeds are the proof of ownership

    get on that website !

    2005 so the Land Registry will have the required records.

    The LR site does not operate at weekends. Don't ask me why.
