Can you say you have thought about it and done a risk assessment on somebody in your head but not actually document it?

Well, it depends. How many employees do you have? Is it a pregnant lady you've done 'in your head'?
The HSE dictates that it only has to be documented in written form if you have 5 or more employees, however, the question might be raised as to what your findings were in the case that someone has had an accident. For a pregnant employee, you really should document the RA.
And, no, I'm not a legal eagle either, just have done it many many times in the past and had to follow the HSE regs.I'll have some cheese please, bob.0 -
This is for my husband, he went to employment tribunal yesterday and this is what his boss said. i just find it extremely odd that a judge would accept this. its like me saying I thought about paying my council tax so therefore it is paid.

How big is the company your husband works for? Does he have any notified disability or anything like that?
WHat did his job involve (e.g. heavy lifting, dangerous machinery etc)?I'll have some cheese please, bob.0 -
