Council tax band too low

If the new owner continued to pay council tax at the current rate, would any future review allow the council to backdate an amended rate back to the purchase date ?
The council would use the date given by the VOA - if the VOA backdate a change the council will issue a backdated bill.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
The property being sold doesn't seem to trigger an auto rebanding upwards, they can't do that until the whole country gets done again (bound to be soon and when they do, all sorts of !!!! will fly about extensions, lofts etc).
Our house is a band lower than all our neighbours (despite being bigger) which I put down to the property only having had an outside toilet at the time it was banded in early 90s.Armchair shopper and cook - albeit with a ready meal on my lap and "plates of meat" in a foot spa!!!!:rotfl::rotfl::rotfl:0 -
Any increase would not be backdated. CT bands can be reviewed at any time and in the past VOA had system where if a sale price and CT band seemed anomalous, the band would be investigated.
OP if you are thinking of buying this house, then to be on the safe side budget for paying an E band, rather than a B. All you need is a disgruntled neighbour moaning that theirs is an E whereas this house is a B and VOA would certainly investigate. I'm ex VOA and had a similar situation 10 years after start of CT where having received a complaint from a Band F taxpayer, increased neighbours' bands from D to F.
If current owners extended or altered property this would trigger the need for a band review when the property is sold.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
