Problem with letting agent

Hello everyone,
I have property rented through letting agent who informed one day that tenant has vacant the property but not provided a month noticed according to contract. tenent has vacant the property 2 month earler then signed contract. After 10 days I realised that this tenent has been shifted to this agents personal property from a reliable source. I wonder if this has breach the code of coduct of letting practice by this letting agent ? what action can I take, where to get advice from ? Can I recover loss of 2 month rent through deposit and serving notice ?

Which? Either the tenancy is a fixed term which has not expired, OR it is periodic and notice is required.not provided a month noticed according to contract. tenent has vacant the property 2 month earler then signed contract.
Either way, if the tenants have left early, you can a) withold their deposit and/or b) sue them in the Small Claims court for rent up till the end of their tenancy.
Agent sounds dodgy - by all means try chasing them too. Write explaining you are aware they've moved the tenants into their own property before the expiry of the current tenancy and therefore you expect them (the agents) to continue to pass the appropriate rent to you.
Don't hold your breath though!0 -
As G_M says, you need to understand your own contract. If the T was on a FT contract then he was obliged to pay rent until the end of that FT unless agreed otherwise by you. A T however does not have to give you notice to be able to leave at the end of a FT - he can just go.
Is the tenancy deposit scheme registered ( property in Eng/Wales)?
Focus first on getting a new tenant in place.
Your LA is supposed to act on your behalf. Change your LA.

Thank you both for your reply. I started this thread behalf of my friend. he is not good with computers so I helped him. sorry, forgot to add that in first post.
I have to ask my friend to see what type of contract he has signed. he paid finder's fee and 10% monthly maintanance charge to EA. initial contract was for six months with tenants. after two weeks, my friend went to see estate agent to collect key. EA has promised to give 2 weeks rent.
I have told my frient to find suitable tenant first then deal with EA. will update after talking with my friend. do you think it's woth going to small court? EA has returned his keys and promise to pay for two weeks (till my friend collected his keys).0
