Walsh Western States Iphone4 Parcel delivered but its not!

I have ordered an iphone4 from Apple on the 7th March. Online tracking says it was delivered on 9th March, signed by David. But I was waiting in all day and no delivery came and there is no one called David in my flat.

Apple started an investigation with the carrier Walsh Western on 10th March. Apple said that an investigation takes 72 hours. After 72 hours no one contacted me so I had to contact Apple again. The driver came to my flat on 17th March to ask if anyone received it. He admitted to me that he was not sure where he delivered the phone but that he gave it to a black guy. There is no black guy in my flat. The driver then knocked the door opposite my flat and got no answer. He even asked me to knock there later and ask if they have received the iphone. He said he would return on Monday(21st March) to find the phone. I haven't seen the driver since 17th. I guess he couldn't find the phone and now lies to Apple that he delivered it to the correct address.


Here is the email from Apple I received today

'
We have concluded our investigation with the carrier who confirmed the iPhone was delivered to the correct address as the driver entered the threshold for the signature. The person who signed for the package is "David". We
have also been informed that the carrier has contacted you to confirm this.'

I am so stressed about the situation. I have contacted my credit card company and they will start an investigation. But I am sure the driver will keep telling a lie and I am worried if I will get refund. What can I do if the credit company also believe the driver? :mad:

    Contact the police and get a crime number and contact Apple again, they may take it a bit more serious if the police are involved

    I would also inform appple of my( i.e. your) recollection of what took place on 17 March.

    Inform Apple again that you have not received the parcel, and there is no-one named David at your address. State that you wish to cancel under Distance Selling Regulations and that you require a full refund.
  • I've told Apple milllion times already that I was waiting in all day and there is no one called David in my flat. I emailed them again yesterday and explained everything and what happened on 17th March. I've emailed them again just now and told them I am going to the police station today and I'm waiting for thier reply.
  • By law in UK is it accepted to deliver the parcel to whoever came out from the address of the recipient without getting signature from the recipient?
